1. Parties and Definitions

This Terms of Use Agreement ("Agreement") governs the terms and conditions between Ender Tekstil Sanayi ve Ticaret Ltd. Şti. ("Company" or "Ender Home"), residing at Pınarkent Mah. Cafer Sadık Abalıoğlu Blv. No:33, 20170 Pamukkale/Denizli, and all real and legal persons ("User") who visit and/or use the website with the domain name www.enderhome.com ("Site").

By accessing or using the Site, the User declares and undertakes that they have read, understood, and accepted all provisions and conditions of this Agreement. If you do not agree to these terms, please do not use the Site.

2. Description of Services

Ender Home is an e-commerce platform that allows users to browse and purchase home textile products (bedding sets, curtains, towels, pillows, decorative products, etc.) online through the Site.

3. User's Rights and Obligations

3.1. The User accepts and undertakes that all information provided while using the Site (name, surname, address, e-mail, phone, etc.) is accurate, up-to-date, and complete. The User is solely responsible for any damages that may arise due to incorrect or incomplete information.

3.2. The User is responsible for the security of the password created when registering on the Site. The Company cannot be held responsible for the seizure of account information and password by third parties and for any damages that may arise therefrom.

3.3. The User agrees to use the Site only for lawful purposes and undertakes not to upload or share any unlawful, threatening, abusive, harassing, pornographic, or intellectual property-infringing material on or through the Site.

3.4. The User undertakes not to use any software, tools, or viruses that would interfere with or obstruct the operation of the Site and not to attempt to bypass the Site's security systems.

3.5. To shop on the Site, users must be at least 18 years old.

4. Intellectual Property Rights

4.1. All content on the Site, including brands, logos, texts, graphics, user interfaces, software, product photos, designs, and codes, are owned by the Company or used by the Company under license.

4.2. This content may not be copied, reproduced, distributed, modified, sold, or used for any other commercial purpose without the Company's written consent. Actions contrary to this will entail legal and criminal liability.

5. Order and Sales Processes

5.1. Products displayed on the Site are an invitation to an offer, not a sales offer. The User's placement of an order is considered an offer. This offer is deemed accepted upon the Company sending an order confirmation, and a contract is thereby established between the parties.

5.2. The Company reserves the right to reject or cancel an order or request additional information before confirming the order. Orders may be canceled in cases such as out-of-stock products or obvious pricing errors.

5.3. All sales transactions conducted through the Site are subject to the provisions of the Distance Sales Agreement, Preliminary Information Form, Return and Exchange Policy, and other relevant legal texts. By placing an order, the User is deemed to have accepted the terms of these documents.

6. Limitation of Liability

6.1. The Company does not guarantee that the Site will be uninterrupted or error-free. While the Company exercises maximum care regarding the accuracy, currency, and completeness of the information on the Site, it cannot be held responsible for problems arising from technical or typographical errors. The Company reserves the right to correct such errors as soon as they are identified.

6.2. The Company shall not be liable, to the maximum extent permitted by law, for indirect, incidental, or consequential damages arising from the use of the Site or products purchased through the Site.

7. Amendment of the Agreement

The Company reserves the right to unilaterally amend this Agreement and all other policies on the Site at any time without prior notice. Amendments shall become effective on the date they are published on the Site. By continuing to use the Site, the User is deemed to have accepted these amendments.

8. Governing Law and Jurisdiction

The laws of the Republic of Turkey shall apply to the interpretation and application of this Agreement. The Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction over any disputes arising from this Agreement.
