Membership Agreement

Article 1: Parties and Subject Matter

This Membership Agreement (“Agreement”) is entered into between Ender Tekstil Sanayi ve Ticaret Ltd. Şti. (“Company”), residing at Pınarkent Mah. Cafer Sadık Abalıoğlu Blv. No:33, 20170 Pamukkale/Denizli, and a natural or legal person (“Member”) who becomes a member of the website named www.enderhome.com (“Site”) under the conditions specified in this Agreement.

The subject of this Agreement is to determine the conditions for the Member to benefit from the services offered on the Site and the rights and obligations of the parties.

The Member declares and undertakes that by filling out the membership form on the Site and clicking an “Become a Member” or similar button to complete the registration process, they have read, understood, and accepted this Agreement, as well as the Terms of Use, Privacy Policy, and all other relevant policies and rules as a whole.

Article 2: Membership Conditions

2.1. To become a Member, one must be over 18 years of age and have the legal capacity to exercise civil rights.

2.2. The Member is obliged to provide all information requested in the membership form (name, surname, e-mail, password, etc.) accurately, completely, and up-to-date. The Member is personally responsible for any damages that may arise due to this information being false or incomplete. The Company reserves the right to suspend or terminate membership in such cases.

2.3. Each Member may only have one account. Duplicate memberships may be merged or cancelled by the Company without prior notice.

2.4. Membership accounts are personal and cannot be transferred or used by third parties.

Article 3: Rights and Obligations of the Member

3.1. The Member is obliged to comply with all rules specified in the Terms of Use when using the Site.

3.2. The Member is personally responsible for ensuring the security and confidentiality of their account password. In case the password is forgotten, stolen, or its unauthorized use is noticed, the Company must be notified immediately. All responsibility arising from negligence in password security belongs to the Member.

3.3. The Member agrees to use their account and Site services for lawful and moral purposes, and not to infringe upon the rights of third parties.

3.4. The Member undertakes not to misuse discount coupons, points, and similar advantages defined for their account, and not to sell or transfer these rights for commercial purposes.

Article 4: Rights and Obligations of the Company

4.1. If the Company determines that the Member has acted contrary to this Agreement or other relevant policies, it has the right to temporarily suspend or permanently terminate the Member's account without prior notice.

4.2. The Company reserves the right to change, discontinue, or expand the technical infrastructure (Shopify) of the Site and the services it offers without prior notice.

4.3. The Company takes necessary technical measures for the Member's security. However, despite all measures, it cannot be held responsible for damages arising from cyber attacks or technical malfunctions.

4.4. The Company may send systematic and mandatory informational e-mails to the Member regarding the service (such as order confirmation, shipping notification, password reset) concerning the membership account. These communications are not for marketing purposes and cannot be stopped.

Article 5: Processing of Personal Data

By accepting this Agreement, the Member consents to the processing of their personal data by the Company for the purposes of establishing and managing the membership relationship, linking order history to the account, and providing member-specific services. For detailed information on the processing and protection of personal data and the Member's rights in this regard, the KVKK Disclosure Text and Privacy Policy apply.

Article 6: Termination of Membership

6.1. By the Member: The Member may request termination of their membership at any time by sending an e-mail to info@enderhome.com or by following the relevant steps in the account panel on the Site.

6.2. By the Company: In addition to the violations specified in Article 4.1, the Company may terminate membership due to reasons such as the Member not using their account for a long time or legal obligations.

6.3. The termination of membership does not prejudice the Member's past orders or rights and obligations arising from legal regulations. The Company reserves the right to retain relevant data for legal retention periods.

Article 7: Other Provisions

7.1. Turkish Republic laws shall apply to the resolution of disputes arising from this Agreement, and the Courts and Enforcement Offices of Istanbul (Çağlayan) shall have jurisdiction.

7.2. This Agreement comes into force at the moment it is published on the Site and is deemed to have been accepted by the Member at the moment the registration process is completed. The Company may update the Agreement at any time by publishing it on the Site.
